General Terms and Conditions (GTC)

1. Scope and Contracting Party

These General Terms and Conditions apply to orders placed through the AuraGleam online store at auragleamjewelry.com.

Our offer is directed exclusively at consumers within the meaning of Section 13 of the German Civil Code (BGB), i.e. natural persons who enter into a legal transaction for purposes that are predominantly outside their trade, business or profession.

2. Conclusion of Contract

The presentation of products in our online store does not constitute a legally binding offer to conclude a purchase contract, but rather an invitation to place an order.

You can select the desired products and add them to your shopping cart. Before submitting your order, the checkout displays the essential order information, in particular the selected products, prices, shipping costs and available payment methods.

Before submitting your order, you can review and correct your entries.

By clicking the button used to place the order with an obligation to pay, you submit a binding offer to purchase the products contained in your shopping cart.

The purchase contract is concluded when we accept your order immediately after completion of the order by sending you an order confirmation by email.

The payment method selected by you may be charged or authorized immediately in connection with completion of the order.

3. Contract Text, Correction of Input Errors and Contract Languages

Before submitting your order, you can identify and correct input errors using the functions provided in the shopping cart and checkout.

We store the order data required for processing the contract. You will receive an overview of your order by email after completing the order. If you use a customer account, information about your orders may also be available there depending on the functions provided.

These General Terms and Conditions can be accessed and saved through our online store both before and after conclusion of the contract.

The contract may be concluded in the languages offered in the respective online store or checkout, in particular German and English.

We are not subject to any specific codes of conduct unless expressly stated otherwise.

4. Prices, VAT and Shipping Costs

The prices stated in the online store are shown in the currency displayed at the time.

For deliveries within the European Union, the stated product prices include the applicable statutory VAT.

Additional shipping costs may apply. The respective shipping costs are displayed in the online store or, at the latest, in the checkout before the order is submitted.

Deliveries to the USA

For deliveries to the USA, taxes and import duties are prepaid or covered by us in accordance with the shipping conditions stated in the online store. Where the respective shipping option indicates that such charges are included, the customer will therefore not incur any additional customs or import duties upon importation.

Other Countries Outside the European Union

Deliveries to other countries outside the European Union may be subject to additional customs duties, import taxes or other government charges.

Unless expressly stated otherwise in the online store or checkout, such import charges must be borne by the customer. They may be charged by the competent authorities or by service providers involved in importation and delivery and are not determined by us.

5. Payment Methods

The payment methods available for the respective delivery country are displayed in the checkout.

Payment processing is carried out in particular via Shopify Payments and PayPal. Depending on the country, device and availability, Shopify Payments may offer, among other things, card payments, Shop Pay, Apple Pay, Google Pay and local payment methods.

Unless otherwise stated for the respective payment method, the purchase price is due upon conclusion of the purchase contract.

The terms and conditions of the respective selected payment service provider may additionally apply to payment processing.

6. Delivery and Delivery Times

We deliver to the delivery countries available for selection in the online store.

The shipping costs and estimated delivery times applicable to the respective order are set out in the online store, in the checkout and in our Shipping Information.

Unless otherwise stated, the stated delivery times begin after conclusion of the contract or successful payment processing.

International deliveries may be delayed in particular due to customs clearance, administrative procedures or circumstances affecting the respective shipping provider over which we have no direct control.

Pre-Orders

Where products are offered as pre-orders (“Preorder”), they are marked accordingly in the online store.

The estimated shipping or delivery period applicable to the respective pre-order is stated in the product description.

7. Mystery Bags

Our Mystery Bags are surprise products individually assembled for each respective order.

Individual Assembly

The specific contents of a Mystery Bag order are not determined before the order is received.

Depending on the quantity ordered, the customer selects one or more preferred colors and may additionally communicate personal preferences to us. These may include, in particular, requests or exclusions regarding certain types of jewelry, product groups, designs or collections, as well as preferences regarding the distribution of gold- and silver-colored jewelry.

Based on this information and the customer's personal preferences, an individual selection of suitable pieces of jewelry is assembled for the respective order, from which the specific pieces for the Mystery Bags are subsequently selected or drawn.

The assembly therefore takes place only after receipt of the order and is individually adapted to the selected preferred colors and personal preferences communicated by the respective customer.

The customer does not determine the specific piece of jewelry contained in an individual Mystery Bag in advance. The element of surprise associated with the specific selection remains part of the Mystery Bag concept.

Preferred Colors and Prize Mechanism

Each Mystery Bag contains one piece of jewelry and one color marker.

If the color marker matches one of the preferred colors selected for the respective order, the customer receives an additional Mystery Bag in accordance with the rules stated at the time of the order. Multiple prizes within a single order are possible.

The preferred colors available, the number of preferred colors that may be selected and further details are set out in the respective product description.

Individual Order Video

An individual order video relating specifically to the respective Mystery Bag order and its assembly is additionally created for Mystery Bag orders.

Where such videos are published through our social media channels, the applicable privacy information and, where required, any consent given additionally apply.

Right of Withdrawal for Mystery Bags

Because the Mystery Bag order is individually assembled only after receipt of the order on the basis of the selected preferred colors and personal preferences, our Mystery Bag orders constitute goods made to the customer's personal requirements.

Accordingly, there is no statutory right of withdrawal for such customized Mystery Bag orders pursuant to Section 312g(2) No. 1 of the German Civil Code (BGB).

Statutory rights relating to defective, damaged or non-conforming goods remain unaffected.

8. Charm Studio

For products from our Charm Studio, customers can select an individual combination from the bracelets, necklaces, charms and other options offered in the online store.

The charms selected by the customer are attached to or assembled with the selected piece of jewelry in accordance with the order.

The characteristics and components of the ordered product are determined by the respective product description and the selection made by the customer.

Where the statutory requirements for excluding the right of withdrawal on the basis of specific customization are not met, the statutory right of withdrawal remains unaffected.

9. Digital Gift Cards

Digital AuraGleam gift cards can be purchased through our online store.

The gift card is provided electronically in the form of a gift code and may be used for orders in our online store in accordance with the conditions stated at the time of purchase.

The gift card may be redeemed up to the amount of the available balance. Any remaining balance may be used for subsequent orders.

The value of the gift card will not be paid out in cash unless mandatory statutory provisions provide otherwise.

Unless a longer validity period is expressly specified, the statutory limitation periods apply.

10. Promotions, Prizes and Free Gifts

For discount promotions, free gifts, prize mechanisms, promotional codes or other time-limited offers, the conditions stated for the respective promotion apply in addition to these Terms and Conditions.

Where a promotion is subject to requirements such as a minimum order value, a certain product quantity, a specific product or a promotional period, these requirements will be stated in connection with the respective promotion.

Free gifts or prizes cannot be exchanged or redeemed for cash.

If, as a result of an effective reversal of an order, the conditions for a free gift linked to the order are no longer met, that free gift must also be returned in accordance with the applicable statutory provisions.

Statutory consumer rights are not restricted by discount promotions or free gifts.

11. Retention of Title

The delivered goods remain our property until the respective purchase price has been paid in full.

12. Statutory Liability for Defects

The statutory rights relating to defects apply to our goods.

We do not provide any separate guarantee beyond these statutory rights unless a guarantee is expressly offered for a specific product and the applicable guarantee conditions are stated.

For jewelry made from natural materials such as natural stones, crystals or pearls, natural variations may occur, in particular with regard to color, structure, shape, pattern or surface. Such material-specific variations do not constitute a defect provided that the goods conform to the agreed characteristics and product description.

13. Right of Withdrawal

Consumers generally have a statutory right of withdrawal in relation to distance contracts unless a statutory exception applies.

Information on the requirements, deadlines, procedure and consequences of withdrawal can be found in our separate Cancellation Policy / Instructions on the Right of Withdrawal.

In addition, we provide the legally required electronic “Withdraw from Contract” function in our online store.

The statutory exception to the right of withdrawal described in Section 7 applies to customized Mystery Bag orders.

Statutory rights in the event of defective or non-conforming goods exist independently of the right of withdrawal.

14. Liability

We are liable in accordance with the statutory provisions.

In particular, these General Terms and Conditions do not limit statutory claims for damages arising from injury to life, body or health, intentional or grossly negligent conduct, or mandatory statutory liability provisions.

15. Shopify and Technical Provision of the Online Store

Our online store is operated and hosted using Shopify.

In connection with visits to and use of our online store and with orders, Shopify processes personal data in order to provide store, checkout, payment and other Shopify services.

Shopify Network Intelligence is enabled in our store. As part of so-called enhanced services (“Enhanced Services”), Shopify may therefore also use information from interactions with our store, other Shopify merchants and Shopify.

Information regarding activities in our store may for this purpose be transmitted to Shopify and other service providers involved in providing these services, which may also be located in other countries.

16. Applicable Law

The laws of the Federal Republic of Germany apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

In the case of consumers, this choice of law applies only to the extent that it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which they have their habitual residence, provided that such mandatory provisions would apply in the absence of the choice of law.

17. Consumer Dispute Resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

18. Changes to these General Terms and Conditions

For each order, the version of these General Terms and Conditions that became part of the respective contract at the time the contract was concluded applies.

Subsequent amendments to these General Terms and Conditions do not alter purchase contracts that have already been concluded unless otherwise validly agreed or required by mandatory statutory provisions.
